Custody and parental rights affect how child support is carried out, but they do not automatically remove the obligation. Even if parental authority is limited, a parent may still be required to provide support.

What child support is and when it applies

Child support covers the maintenance and development of the child. The duty arises when the child cannot support themselves or their needs are not met by the parents. Basics: Maintenance obligation — what it is.

Parental authority and the obligation

Limitation or removal of parental authority does not automatically end the duty to pay support. Courts always assess the child’s needs and the parent’s capacity.

Alternating (shared) custody and support

With alternating custody, both parents usually cover costs during their parenting time. This does not automatically remove support — when incomes differ, courts may set a balancing payment.

Contact with the child vs payment duty

Contact arrangements do not replace child support. The duty exists to meet the child’s needs, not to settle disputes between parents.

Adoption and child support

As a rule, adoption transfers the obligation to adoptive parents. The biological parent loses the duty unless specific rules provide otherwise.

Establishing paternity and support

If paternity has not been acknowledged, support can be ordered after a court determination of paternity. Only then can enforcement be pursued.

Foster care and custody

Placement in foster care does not automatically terminate the parents’ obligation. The duty generally continues and the court assesses the situation individually.

Child’s residence and support

Where the child formally resides does not cancel the other parent’s duty. Courts look at the real costs and each parent’s contribution.

Interim support during custody disputes

When custody or residence is disputed, a parent can request interim support to secure the child’s needs until the case is resolved.
