How does the calculator work?

In Poland alimenty are not set by law in fixed amounts. Art. 135 § 1 of the Family and Guardianship Code provides that the scope of maintenance depends on the justified needs of the entitled person (e.g. the child) and the earning and asset capacity of the obligor. The court sets the amount after hearing the case. This calculator shows an indicative range based on case law and does not replace the court’s assessment.

Conditions and exceptions

On what basis is the amount of alimenty set?

Where do the percentage ranges (15–20%, 8–12%) come from?

From court practice. Courts often use about 15–20% of income for one child and about 8–12% for each further child. The calculator reflects these ranges for estimation only.

Can the court award alimenty higher or lower than the calculator?

Yes. The court examines the child's needs and the parent's capacity. The result may be outside the calculator range.

What is the alimenty fund and when can you use it?

Benefit from the fund is due when enforcement of alimenty fails and statutory criteria are met. Details: gov.pl.

Until when does a parent pay alimenty for a child?

Art. 133 § 1: until the child is able to support themselves. Age is not decisive — education and real self‑support are key.

Can alimenty be reduced or increased?

Yes. If circumstances change you can apply to the court to change the order. A change requires proceedings.

Do benefits from the alimenty fund count towards the child's needs?
