The alimony fund is a state benefit for children when enforcement against the obliged parent is ineffective and statutory conditions are met. It does not replace the maintenance case — it applies when a judgment or settlement exists but the money cannot be effectively collected.

What child support is and when it applies

Child support covers the maintenance and development of the child. The duty arises when the child cannot support themselves or their needs are not met by the parent. Basics: Maintenance obligation — what it is.

When the fund applies

Payments are available when these conditions are met:

  • an enforceable title exists (judgment or settlement),
  • enforcement is ineffective,
  • income criteria and statutory requirements are met.

The enforceable title and proof of ineffective enforcement are the key elements.

Income criterion and amount

The alimony fund is means‑tested. The income criterion is PLN 1209 per person and payments follow the “złotówka for złotówka” mechanism. The maximum benefit from the fund is PLN 1000 per month. These parameters are set by law and can change, so check the current thresholds before filing.

Where to file

Applications are filed with the local municipality/commune office (often through social assistance units). Complete documentation is key — missing attachments usually delay the decision.

Benefit period and renewal

The entitlement is granted for a defined benefit period. After it ends, you usually need to apply again, so it is worth tracking application windows to avoid gaps in payments.

When payments stop

Payments can stop if the income criterion is no longer met, enforcement becomes effective, or the child no longer meets the statutory conditions.

What “ineffective enforcement” means

It means the bailiff could not collect the amounts due in the required scope. You typically need a certificate from the enforcement proceedings. Without it, the fund will not pay.

Who can receive the benefit

The benefit is for the child, but the application is filed by the parent/guardian. After 18, it can still apply if the child continues education and the statutory criteria are met. See: Until when is child support paid.

Typically required:

  • an enforceable title,
  • certificate of ineffective enforcement,
  • family income documents,
  • school/university documents (if applicable).

Does the fund replace enforcement

No. The fund applies only when enforcement is ineffective. In practice, enforcement is a prerequisite.
