Retroactive child support and back payments apply when the court sets support for an earlier period or raises the amount with a retroactive date. This is not automatic and requires justification and evidence of needs and capacity for that period.

What child support is and when it applies

Can you claim retroactively

In principle, the court may award support for a period before filing, but it requires specific justification. You must show that the child’s needs were unmet and the obligor had the capacity to pay. Limitations result from rules on limitation of periodic claims, so acting quickly matters.

If one parent covered the child’s expenses alone for a long time, they can try to show that the other parent should have shared those costs. Concrete evidence from that period is essential.

Back payments after an increase

If the court increases support with a retroactive date, a back payment arises. It is usually the difference between the new and the old amount for the period indicated. Evidence of costs and finances from that period is key.

Back payments after judgment

The period can start from the filing date or another date specified by the court, depending on the judgment and circumstances.

Back payment vs arrears

Back payments arise when the court sets a higher amount retroactively. Arrears are unpaid installments due under an existing judgment or settlement. These are different concepts, though they can overlap in practice.

Key evidence

The most important documents usually include:

  • receipts and invoices from the period in question,
  • medical and education costs,
  • income information of both parties from that time,
  • a monthly cost breakdown.
