Support from grandparents is an exception and has a subsidiary character. It arises only when parents cannot meet the obligation and enforcement against them is ineffective or impossible.

What child support is and when it applies

Courts may order grandparents to pay when:

  • the parents are deceased, unable to work or their whereabouts are unknown,
  • enforcement against parents is ineffective,

Grandparents are a “second‑line” source of support. The court reaches for their resources only after it is clear that the parents cannot perform the duty or enforcement has failed.

The court assesses the grandparents’ financial capacity, life circumstances and the child’s justified needs. The obligation is not automatic and grandparents can show limited capacity.

Do you have to sue both grandparents

In practice, claims usually concern the grandparents on one side of the family. The court can distribute the obligation between them based on their financial and health situation.

Typical evidence includes:

  • an enforceable title against the parent,
  • enforcement documents showing ineffectiveness,
  • a child cost breakdown,
  • information about parents’ and grandparents’ financial situation.

How the proceedings usually look

The claim is filed with the family court. The key issues are ineffective enforcement against the parents and the real, justified needs of the child. Evidence is crucial throughout the case.

How to prepare a cost breakdown

The more detailed the cost breakdown, the easier it is to prove justified needs. Gather receipts for housing, food, education, health care and extracurricular activities.

When the obligation ends
