Support for parents from adult children is an exceptional duty linked to the concept of need. The parent must show inability to meet basic needs, while the child must have real capacity to provide support.

What child support is and when it applies

When a parent can claim support

Most often when:

  • the parent is in need,
  • they cannot support themselves,
  • adult children have financial capacity.

Need means inability to cover basic necessities, not merely a lower standard of living.

What “need” means in practice

In practice it is a lack of funds for basic living costs: housing, food, treatment, or necessary care. Courts review real income, health status and the ability to work or obtain other support.

How the obligation is split among siblings

If there are several adult children, the court can split the obligation based on each child’s real financial capacity. It is not necessarily equal shares.

What the court considers

Courts assess:

  • the parent’s real needs (housing, medical care, daily living),
  • the children’s earning and property capacity,
  • family relations and whether the parent fulfilled duties in the past.

Serious neglect of parental duties can influence the assessment.

When the court may dismiss the claim

The claim can be dismissed if it contradicts the principles of social coexistence, for example when the parent persistently neglected the child in the past. The assessment is always fact‑specific.

How to prepare the claim

In the claim, describe:

  • the nature of the need,
  • living costs,
  • any existing income,
  • the children’s financial situation.

Typical evidence includes medical documentation, treatment costs, a cost breakdown and proof of the children’s income.

When the obligation may end

The duty can end when the parent regains financial independence or when the children lack real capacity to pay. Each case is assessed individually.

Mediation and settlement

Family disputes can often be resolved through mediation. A court‑approved settlement can set a realistic level of support without a long trial.
