Public benefits (for example 800+) do not replace child support. They can be part of the overall financial picture, but they do not remove a parent’s duty.

What child support is and when it applies

Does 800+ affect child support

Courts may consider public benefits as part of the child’s budget, but they do not replace the parent’s obligation. In practice, 800+ is treated as support for the child, not income of the obliged parent.

Why 800+ does not replace support

The benefit is a public contribution to the child’s welfare, not a substitute for parental responsibility. The duty to provide maintenance follows from family law and is assessed based on the child’s needs and the parents’ capacity. Benefits may reduce the overall budget gap, but they do not eliminate it.

How courts use benefits in practice

Courts look at the full financial picture:

  • the monthly costs of the child,
  • the contribution of each parent,
  • public benefits received for the child.

This means 800+ can be shown in the budget, but it is only one element. The court still expects parents to cover the remaining justified needs.

Other benefits and support

Similar treatment applies to other benefits such as family allowances or survivor’s pensions. They can affect the overall assessment but do not eliminate the duty.

How to include benefits in the cost breakdown

Prepare a transparent monthly budget:

  • list all child‑related costs by category,
  • show benefits (800+ and other payments) as income for the child,
  • indicate how much each parent contributes.

This structure makes it clear that benefits do not fully cover the costs and why support is still needed.

Example budget logic

If monthly costs are 3,000 PLN and the child receives 800+, there is still a 2,200 PLN gap to be covered by parents. The court then assesses how this gap should be split based on each parent’s capacity and actual care.

Documents worth preparing

Useful materials include:

  • receipts and invoices for housing, food, education and health care,
  • confirmation of benefits received,
  • income documents of both parents,
  • a monthly cost table showing the gap to be covered.

Alimony fund and benefits

Benefits vs enforcement

Receiving 800+ does not block enforcement. If support is unpaid, you can still pursue enforcement and the court will treat benefits as part of the child’s budget, not as a substitute for the arrears.
